All lawsuits regarding cases in which a person suffered physical (or mental) damage as a result of a tortious act by another party are included under the heading "personal injury lawsuits".

The common denominator of these lawsuits is that a person must prove that he or she suffered physical or mental damage as a result of an act by another party. That "other party" can be a private individual, a commercial company, or a governmental body.

Within the framework of these lawsuits are included lawsuits for car accidents regulated by a unique Israeli law called the "Compensation for Road Accident Victims Law". The uniqueness of this law is that the accident victim is not required to prove that his or her damage was caused "by the fault" of anyone. All he or she must prove is that physical or mental damage was caused as a result of the use of a motor vehicle.

A separate group consists of work accident victims who sue their employers for physical or mental injury that occurred during work and due to work – as a result of the employer's negligence. These victims are entitled to compensation from the National Insurance Institute up to the ceilings set in the National Insurance Law, and if the damages exceed the National Insurance payments, they have the option to sue the employer as well.

Another group that will be discussed in this brief review includes all people who are injured physically or mentally due to an act of negligence by another party, such as someone who trips on a broken sidewalk in the street and sues the municipality, someone who slips on a wet floor in a hotel lobby or shopping mall and sues the property owners, or a child who is injured at school due to an obstacle or sharp object that was not removed and caused damage, whose parents sue the local authority operating the school or even the Ministry of Education.

Finally, it should be noted that personal injuries caused by medical malpractice, namely damage to the body or mind caused to patients due to receiving medical treatment that was provided contrary to the accepted medical standard or due to failure to provide medical treatment contrary to what was required.

These are, of course, only a few examples of the types of cases and lawsuits that are brought to our office on a daily basis.
