Mrs. P. became pregnant unexpectedly at age 40 and sought to terminate the pregnancy through abortion, but at the last moment was convinced to continue with the pregnancy, after reaching an agreement with her gynecologist that the pregnancy would receive close supervision and monitoring, and that in any case where there was concern for the fetus's wellbeing, the doctors would terminate the pregnancy. In practice, the promises proved to be false and the treatment and monitoring provided for this pregnancy were inadequate and negligent. Red Crescent Hospital Association v. John Doe (Appeal 4512/13 in the Supreme Court)

29.12.2016

The verdict establishes a new precedent regarding the statute of limitations for lawsuits in which significant defects were missed during pregnancy. Until about two years ago, a child suffering from defects was entitled to file a lawsuit for compensation until reaching the age of 25. The Supreme Court then ruled that this option would be limited to age 7 only. Now, following the legal proceeding conducted by our law office, the door is open to file such lawsuits until August 27, 2015 (that is, within one year) even if 7 years have passed since the date of childbirth. This represents an important achievement for a large population of injured children and their parents.

Mrs. B.M. was under fifty years old when she began suffering from severe and persistent abdominal pain.
