Civil Appeal 11219/07 and Civil Appeal 11311/07 Y.B. v. Dr. Uriel Wald

The plaintiff approached the defendant with complaints of back pain.
The doctor recommended that he undergo back surgery. In retrospect, it turned out that the surgery was performed at the wrong level and, worse still, the doctor did not report the error to him.
As a result, the plaintiff continued to suffer from back pain and was left with permanent disability. He filed a lawsuit through our office against the doctor and his insurance company.
The Magistrate's Court awarded the plaintiff compensation totaling approximately NIS 700,000.
The District Court not only rejected the doctor's appeal of the verdict but also accepted the plaintiff's appeal and added an additional sum of NIS 180,000 to the compensation amount, and further determined that the plaintiff is entitled to all damages (and not just 90% of them), so that together with legal costs, the total compensation amounted to approximately NIS 1.25 million.
