Professional Experience
David Winter is a partner at Ron-Festinger Law Office.
David specializes in the field of torts in all its aspects, with extensive experience in medical malpractice. In addition, David specializes in representing car accident victims in lawsuits against insurance companies.
David holds a Bachelor of Laws degree (LL.B) from Bar-Ilan University, and is certified as a rabbi by the Chief Rabbinate of Israel.
Before being admitted to the bar, David interned at Ron-Festinger Law Office, and joined the permanent team at the office following his admission.
Together with Attorney Ron, he was a partner in several landmark cases, some of which reached the Supreme Court, including:
Eliyahu Ashkenazi v. Clalit Health Services – A landmark ruling regarding physician and patient responsibility. The case reached the Supreme Court, which ruled that a patient who feels unwell and seeks medical advice is not required to obtain a second opinion, and if the initial advice was defective – full responsibility lies with the physician who provided that advice. The ruling addresses a core issue in medical malpractice and sets policy regarding physician and patient responsibility.
L.D. v. Hillel Yaffe Medical Center – A ruling that established a fundamental precedent in tort law, effectively reversing a long-standing doctrine. The ruling established that if the patient's chance of recovery following medical treatment is greater than 51% – then the compensation should not be reduced by the risk that existed from the outset in providing the treatment. Prior to this ruling, the prevailing rule was to reduce the compensation due to a person who suffered from defective medical treatment by an amount equivalent to the risk of treatment failure even without negligence.
A.Y. v. Health Fund – Together with Attorney Pestinger, he was a partner in a landmark Supreme Court ruling that overturned a district court decision and determined that a minor's claim for failure to diagnose Down syndrome was not time-barred, despite the shortening of the statute of limitations for such claims that took effect before the claim was filed.
